Due Diligence describes the process of scrutinising the facts
related to a transaction in order to mitigate risks.
Our Due Diligence process typically
applies scrutiny to various aspects of an investment, asset,
transaction, contract, and counter-party. Specific aspects of
the due diligence may include document translation and verification;
pre-qualification, pre-approval, and eligibility assessment;
compliance assessment of permits & permissions, regional, local
and urban planning constraints, cadastral references, appraisal
reports, surveys and searches; insured risks, liens, tax and
other liabilities and claims; transaction terms; special purposes
corporate formation; contracts related to sale, purchase, construction,
off-plan construction management, and management service charges;
credit protocols and secured loan facilities; project risk assessments,
geological surveys and soil studies, etc etc
Typical due diligence we advise having
executed, as would be expected elsewhere but is rarely carried
out in residential property purchases in Turkey, includes:
Review of cadastral, local planning compliance, and permits
Search for liens, encumbrances, unpaid taxes and utilities
We apply various Pre-Qualification and Assessment techniques
for different types of transactions:
a) Counter Party Risk Assessments
including finance providers and lending institutions
b) Pre-Qualification and Assessment of single residential mortgage
and project & investment finance applications.
c) Pre-Qualification of investment acquisition assets and project
development proposals
Beware using solicitors
and mortgage brokers referred by the seller where thorough
due diligence has not been completed in 2007 there have been
several cases where such combination has lead to unforeseen
closing costs. We have saved developers, residential
buyers, and investors hundreds of thousands of pounds of heartache
and financial loss, simply by providing knowledgeable advice,
early in the process. Additional support regarding contracts,
permits, and contract completion, are part of the conveyance
and Transaction Management Services we provide.
